Domain name disputes began to reach the courts in 1994. As the importance of the Internet as a commercial medium grew, the number of trademark disputes involving domain name grew accordingly. Unfortunately, the existing rules proved inadequate. This paper covers the background and philosophy leading to two developments to address the problem.
