Alexis E. Payne

Alexis counsels clients on a wide range of promotional, advertising, claim substantiation and other marketing activities. Her key areas of practice include Advertising and Promotions, Media, Internet and E-Commerce, Copyright, Trademarks, Brand Development and Protection, and Litigation.

Given the rapidly changing legal requirements, competitive concerns and enforcement priorities in marketing activities that evolve with the same speed as the new technologies deployed, Alexis keeps abreast of and counsels clients on such issues. Alexis' expertise embraces all levels of complex advertising and marketing campaigns, from a basic sweepstakes, to a co-branded multilevel marketing campaign that encompasses potentially conflicting regulatory, licensing, intellectual property, publicity and privacy issues in a number of jurisdictions. In addition, Alexis has extensive experience in assisting in the structuring and review of user-generated online contests, incentive/loyalty programs, and gift card promotions.

In addition, Alexis has represented various clients, including retailers, publishers, radio and television production companies, and major record labels, in cases involving myriad legal issues, including copyright, trademark, false advertising, breach of contract, defamation, privacy and tort claims. With significant experience in state and federal court, Alexis knows the judges, how the judicial system works, and applies this knowledge to litigate cases expeditiously.
