Jessica Ekhoff specializes in trademark, unfair competition, advertising, and copyright law. Jessica has extensive litigation experience, securing wins for clients before federal district and appellate courts across the country, the Trademark Trial and Appeal Board, the National Advertising Division, and the National Advertising Review Board. Her cases often involve working with expert witnesses on survey design, including likelihood of confusion, secondary meaning, and primary significance surveys.

Jessica represents clients across a range of industries, including those in the food and beverage, fashion, technology, pharmaceutical, and tool fields. Her recent victories include a motion to dismiss design patent and trade dress infringement claims regarding women’s ballet flat shoes that resulted in the plaintiff dropping the case, and successfully defending a sports reporter against a breach of contract claim filed by her former manager with the American Arbitration Association.

Complementing her litigation work, Jessica’s practice also includes advertising claim substantiation, drafting contest and sweepstakes rules, including for social media promotions, trademark counseling, clearance, and prosecution, and international trademark portfolio management. She helped a health technology start-up expand their brand into numerous jurisdictions across Europe and Asia, manages the fast-growing trademark portfolio of a leading gluten-free food brand, and has successfully obtained federal registrations for non-traditional marks, including color marks and motion marks.

Outside the office, Jessica is actively involved in the Chicago community. She is a mentor at The University of Chicago’s Polsky Exchange, a startup incubator for U of C and southside entrepreneurs, and is a weekly 4th grade math and reading tutor with Tutoring Chicago. She serves on the Associate Steering Committee of The Coalition for Women’s Initiatives, and has planned events related to performance reviews, intergenerational teams, and career changes within the legal profession. Jessica is also on the Associate Board of Lawyers for the Creative Arts, where she works to provide free legal resources to Chicago’s creative community.

On the weekends, you can find Jessica performing or watching improv comedy, exploring one of Chicago’s amazing neighborhoods, or keeping tabs on the international figure skating circuit.
